The single most thing to do when applying for an Italy Visa is to take particular care in preparing your application and be sure to follow the instructions and document requirements for the specific type of entry visa you are seeking. Most of the times visa applicants do not fulfill any one or more of the Italy visa requirements, which results into a visa rejection. If you have applied for an Italy Visa and it has been refused by the Italian embassy or consulate, you can appeal against the unfair refusal.
Negative decisions on applications are notified to the applicant. In the refusal letter reasons on which refusal decision was taken are clearly stated. Visa applicants whose applications are refused can decide to apply again or to appeal. Only in the case of refusal of family reunification or accompanying family member visas, the eventual appeals may be lodged to the competent ordinary Court without limits of time.
In all aspects you must have valid grounds to dispute the decision. It is important to identify basis of fact or law that undermines the consular decision. The applicant can appeal against the refusals of the Italian Embassy and Consulate to the Regional Administrative Court of Lazio based in Rome.
When to file an appeal:
Here time is of utmost essence because the Embassy will not consider late applications. If you receive a denial of your visa application from the Italy Embassy or Consulate, you should bear in mind that there is a 60-day time limit for lodging an appeal against the denial itself. If you let that time limit lapse, then the denial becomes definitive and cannot be overturned in the Courts.
Where to appeal:
Appeals must be brought against refusal decisions directly at the T.A.R. of the Latium Region, through a lawyer acting on applicant behalf, within 60 days of the serving of the decision itself. The appeal will have to be notified, under penalty of nullity (as per art. 144 of C.P.C. and art. 11 of R.D. no. 1611 of 1933), to the relevant "Avvocatura dello Stato".
Documents required for an appeal:
- Copy of the rejection letter
- Passport with six months validity and minimum two blank pages
- An application form signed by the applicant citing reasons for appeal or review
- Copies of all supporting documents which were submitted with the refused application
Note: In the course of determining the appeal, the consular may request you to provide further evidence.
