Introduction and Acceptance of Terms

These Terms and Conditions (“Terms”) govern all bookings, travel arrangements, products, and services provided by AKBAR TRAVELS OF INDIA LIMITED (“Akbar Travels”, “we”, “us”, or “our”), a company registered in England and Wales under company registration number 08969169, whose registered office is situated at 82 South Road, Southall, Middlesex, UB1 1RD, United Kingdom. These Terms apply to all bookings made through our website, telephone sales channels, email communications, messaging platforms, mobile applications, social media channels, or any other sales platform operated by or on behalf of AKBAR TRAVELS OF INDIA LIMITED. By accessing our website, requesting quotations, communicating with us, or making a booking, you acknowledge that you have read, understood, and accepted these Terms and Conditions in full. You further confirm that you accept these Terms on behalf of yourself and all passengers named within the booking, including minors and any third parties for whom you are authorised to act.

If you do not agree with these Terms and Conditions, you must not proceed with any booking or continue using our services. Completion of a booking constitutes a legally binding agreement between you and AKBAR TRAVELS OF INDIA LIMITED.

About us and our Role

AKBAR TRAVELS OF INDIA LIMITED is an accredited travel company operating under IATA number 9121560-0 and ATOL licence number 12114. We provide travel-related services including but not limited to:

  • Flight bookings;
  • Hotel reservations;
  • Dynamic travel packages;
  • Flight-inclusive holidays;
  • Umrah and religious travel arrangements;
  • Car hire services;
  • Transfers and ancillary travel services.

Depending upon the nature of your booking, we may act either:

  • As an agent for the supplier providing the travel service; or
  • As the organiser of a package holiday.

For standalone services such as flight-only bookings, hotel-only reservations, car hire, or ancillary travel services, we generally act solely as an agent for the airline, hotel provider, or supplier concerned. In such cases, your contract exists directly between you and the relevant supplier, whose terms and conditions shall apply in addition to these Terms. Where your booking constitutes a “Package” under the Package Travel and Linked Travel Arrangements Regulations 2018, AKBAR TRAVELS OF INDIA LIMITED acts as the organiser and accepts responsibility for the proper performance of the package in accordance with applicable law. The nature of our role and the financial protection applicable to your booking will be confirmed within your booking documentation and/or ATOL Certificate where relevant.

Booking Formation and Confirmation

A booking request submitted by you shall not constitute acceptance by us. A legally binding contract shall only come into existence once:

  • Payment has been successfully received;
  • Availability has been confirmed by the relevant supplier;
  • A booking confirmation or invoice has been issued by us.

We reserve the right, at our sole discretion, to decline or cancel any booking request prior to confirmation for reasons including but not limited to:

  • Pricing errors;
  • Supplier unavailability;
  • Technical or system errors;
  • Payment failure;
  • Fraud prevention checks;
  • Duplicate or suspicious bookings;
  • Booking misuse or abuse.

Where a booking cannot be confirmed, any monies received shall be refunded in full and neither we nor the supplier shall have any further liability. It is your responsibility to ensure that all passenger names, dates of birth, passport details, contact information, and travel details are accurate at the time of booking. Passenger names must exactly match the passport or travel document to be used for travel. We shall not be liable for denied boarding, airline penalties, rebooking costs, missed travel, or any losses arising from incorrect information supplied by you.

Pricing, Availability and Errors

All prices displayed on our website or quoted by our representatives are subject to live availability and may change at any time prior to booking confirmation. Airline inventory systems, hotel availability, supplier pricing, taxes, fuel surcharges, exchange rates, and market conditions may cause prices to fluctuate without notice. No price shall be guaranteed until the booking has been fully confirmed and ticketed where applicable. We reserve the right to correct pricing errors or technical malfunctions identified before or after booking confirmation. In the event of a genuine pricing or technical error, we may:

  • Cancel the booking;
  • Offer the booking at the correct price;
  • Provide a full refund of monies paid.

We shall not be liable for any indirect losses, disappointment, or consequential damages resulting from pricing corrections, booking cancellations, or technical errors.

Payment Terms, Deposits and Instalments

All payments must be made in accordance with the payment schedule specified at the time of booking. Where a deposit payment option is available, the remaining balance must be paid by the due date stated within your booking confirmation. Failure to pay the balance by the due date may result in automatic cancellation of the booking and forfeiture of all deposits paid. Deposits are strictly non-refundable unless expressly stated otherwise. We accept payment through approved payment methods including:

  • Debit cards;
  • Credit cards;
  • Bank transfers;
  • Wallet credits;
  • Approved Buy Now Pay Later providers;
  • Other approved payment solutions.

All bookings remain subject to payment verification and fraud screening. Where Buy Now Pay Later or instalment facilities are utilised through provider such as Super Payments, your finance agreement shall exist solely between you and the provider. AKBAR TRAVELS OF INDIA LIMITED is not a lender and accepts no responsibility for approval decisions, repayments, finance agreements, or disputes arising between you and such providers.

Administration Fees

The following administration charges apply unless otherwise agreed in writing:

  • Amendment Fee: £75 per passenger per change;
  • Cancellation Administration Fee: £75 per passenger;
  • Chargeback Administration Fee: £100 per transaction plus all associated legal, supplier, banking, and recovery costs.

Administration charges are separate from supplier or airline penalties and are strictly non-refundable. Where supplier penalties exceed our administration fees, you remain fully liable for the balance.

Flight Bookings and Airline Responsibility

All flights booked through AKBAR TRAVELS OF INDIA LIMITED are subject to the operating airline’s Conditions of Carriage, which form a separate legal contract between you and the airline. As agent for the airline, we shall not be responsible for:

  • Airline schedule changes;
  • Flight delays or cancellations;
  • Aircraft substitutions;
  • Denied boarding;
  • Operational disruptions;
  • Airline insolvency;
  • Lost, delayed, or damaged baggage.

Airlines reserve the right to amend routes, flight numbers, schedules, timings, and aircraft types without prior notice. Such changes do not constitute a breach of contract by AKBAR TRAVELS OF INDIA LIMITED. Passengers are strongly advised to reconfirm all flights directly with the airline at least 72 hours before departure. Failure to reconfirm flights may result in cancellation without refund. Where separate tickets are issued for one journey, each ticket shall be treated as a separate contract. We accept no liability for missed onward connections or transit issues arising from separately ticketed itineraries.

Hotels, Umrah and Other Travel Services

Hotel descriptions, ratings, images, facilities, and amenities are provided by suppliers and may change without notice. Check-in and check-out times are determined solely by the hotel provider. Failure to arrive on the scheduled check-in date may result in automatic cancellation without refund. For Umrah and religious travel services, passengers remain solely responsible for ensuring compliance with:

  • Visa requirements;
  • Vaccination requirements;
  • Immigration requirements;
  • Religious authority regulations;
  • Government travel restrictions.

We shall not be liable for visa refusals, denied entry, border restrictions, airline refusals, or any religious authority decisions. Car hire bookings remain subject to the supplier’s own terms and conditions, including age restrictions, licence requirements, insurance obligations, and security deposits.

Changes, Amendments and Cancellations

Any request to amend a booking must be submitted in writing and shall remain subject to supplier rules, availability, and fare conditions. Many airline fares, promotional offers, hotel rates, and package components are non-refundable and non-changeable after booking confirmation. Where changes are permitted, passengers shall remain liable for:

  • Supplier penalties;
  • Airline charges;
  • Fare differences;
  • Additional taxes;
  • Administration fees.

All cancellation requests must be submitted in writing. Where refunds are permitted by suppliers, refund processing times may vary significantly and may take several weeks or months. Refund timelines remain outside our control. No refund shall be guaranteed until funds are received from the supplier.

Refunds

Refund eligibility is determined strictly in accordance with supplier fare rules and conditions. Non-refundable fares shall remain non-refundable irrespective of whether travel has commenced. Where applicable, recoverable airport taxes may be refundable subject to supplier approval. Administration charges imposed by AKBAR TRAVELS OF INDIA LIMITED remain non-refundable under all circumstances. Refunds shall not be payable for:

  • No-shows;
  • Missed flights;
  • Visa refusal;
  • Failure to obtain travel documents;
  • Passenger error;
  • Failure to check-in;
  • Voluntary unused services where supplier rules prohibit refunds.

Refund processing may take several weeks or months depending on supplier timelines.

Advance Passenger Information (APIS)

Certain airlines and countries require passengers to provide Advance Passenger Information (“API” or “APIS”) prior to travel. This requirement applies particularly to travel involving the United States and certain other international destinations. Passengers agree to provide all requested Advance Passenger Information accurately and within the required timeframe. This information may include:

  • Passport details;
  • Nationality;
  • Country and city of residence;
  • Destination address;
  • Date of birth;
  • Gender;
  • Emergency contact details;
  • Other government-mandated travel information.

Passengers acknowledge and consent to AKBAR TRAVELS OF INDIA LIMITED passing such information to airlines, travel suppliers, border authorities, immigration authorities, and foreign governments where required. Failure to provide accurate or complete Advance Passenger Information within the required timeframe may result in:

  • Refusal to issue tickets;
  • Airline penalties;
  • Debit memos;
  • Denied boarding;
  • Refusal of entry;
  • Cancellation of travel arrangements.

Where cancellation arises due to failure to provide API information, normal cancellation charges and airline fare rules shall apply. Passengers remain solely responsible for ensuring that all API information supplied is complete and accurate.

No-show Policy

Failure to check-in, board, or utilise any booked flight sector may result in automatic cancellation of remaining sectors by the airline or supplier. No refunds shall be payable in cases of no-show unless expressly permitted under the applicable supplier fare rules. We accept no liability for losses arising from:

  • Missed departures;
  • Late arrival at the airport;
  • Failure to present valid documentation;
  • Failure to comply with airline check-in requirements.

Credit Wallet and Vouchers

Any credit, voucher, refund credit, or wallet balance issued by AKBAR TRAVELS OF INDIA LIMITED shall:

  • Be valid for 12 months unless otherwise specified;
  • Be non-transferable unless approved by us;
  • Be redeemable only against services booked through us;
  • Not be redeemable for cash unless required by law.

We reserve the right to deduct supplier penalties, administration fees, fare differences, or other losses before issuing or applying any credit.

Force Majeure

We shall not be liable for delays, cancellations, losses, service interruptions, or failures resulting from events outside our reasonable control including but not limited to:

  • Natural disasters;
  • Severe weather;
  • Floods;
  • Earthquakes;
  • Pandemics or epidemics;
  • Government restrictions;
  • Border closures;
  • War or terrorism;
  • Civil unrest;
  • Industrial action;
  • Airport closures;
  • Air traffic control restrictions;
  • Supplier insolvency.

In such circumstances, compensation shall not be payable and refunds shall remain subject to supplier policies and restrictions.

Customer Conduct

We reserve the right to refuse service, terminate bookings, or cancel travel arrangements where customer behaviour is abusive, threatening, disruptive, fraudulent, or otherwise inappropriate. No refunds shall be payable in such circumstances. Passengers shall remain fully liable for any losses, damages, penalties, or costs incurred as a result of their conduct.

Chargebacks, Fraud and Payment Disputes

Customers agree not to initiate any chargeback or payment dispute without first contacting us to attempt resolution. Any fraudulent, abusive, or unjustified chargeback shall constitute a breach of these Terms and Conditions. Where a chargeback is initiated, we reserve the right to:

  • Suspend or cancel all services;
  • Recover the disputed amount;
  • Apply a £100 administration fee;
  • Recover all legal and recovery costs;
  • Report the matter to fraud prevention databases and payment processors.

All bookings remain subject to fraud screening and identity verification checks. AKBAR TRAVELS OF INDIA LIMITED reserves the right to defend any chargeback using booking records, supplier documentation, communication logs, and payment evidence.

Travel Documents, Passports and Visas

Passengers remain solely responsible for ensuring possession of:

  • Valid passports;
  • Required visas;
  • Transit visas;
  • Vaccination certificates;
  • Health documentation;
  • Any other entry requirements.

We strongly recommend checking current government travel advice before travel. We shall not be liable for losses arising from denied boarding, deportation, refused entry, visa refusal, or failure to comply with travel requirements.

Travel Insurance

We strongly recommend that all passengers obtain comprehensive travel insurance at the time of booking. Travel insurance should include cover for:

  • Medical expenses;
  • Cancellation;
  • Curtailment;
  • Personal liability;
  • Flight disruption;
  • Loss or delay of baggage.

We accept no liability for losses that could otherwise have been covered by adequate insurance.

Liability Limitation

Where we act solely as an agent, our responsibility is limited strictly to arranging the booking with the relevant supplier. We shall not be liable for:

  • Supplier failures;
  • Airline operational issues;
  • Indirect losses;
  • Consequential losses;
  • Loss of enjoyment;
  • Missed connections;
  • Loss of profits;
  • Additional expenses.

Where we act as organiser of a package holiday, our liability shall be limited in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018. Nothing within these Terms excludes liability for death or personal injury caused by negligence where such liability cannot legally be excluded.

Your Financial Protection (ATOL)

When you buy an ATOL protected flight or flight-inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can obtain information regarding your protection, and who to contact if difficulties arise. Agreement with consumers about form of ATOL protection We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate or a suitable alternative. In certain circumstances, where neither we nor the supplier are able to do so because of insolvency, an alternative ATOL holder may provide the services purchased or a suitable alternative at no additional cost.

You agree that where such an alternative ATOL holder is appointed, they shall fulfil those obligations and you agree to pay any outstanding sums due under your contract to that alternative ATOL holder. You further acknowledge that in certain circumstances it may not be possible to appoint an alternative ATOL holder, in which case you may be entitled to make a claim under the ATOL scheme or through your payment card issuer where applicable. Agreement with consumers of assignment of claims If we, or the suppliers identified on your ATOL Certificate, are unable to provide the listed services due to insolvency, the Trustees of the Air Travel Trust may make a payment to you or confer a benefit upon you under the ATOL scheme.

In return for such payment or benefit, you agree to assign absolutely to the Trustees any claims you may have arising out of or relating to the non-provision of services, including claims against us, the travel agent, or your credit card issuer. You further agree that such claims may be reassigned to another body where that body has compensated you under the ATOL scheme. Complaints Procedure

Failure to report issues promptly may affect your ability to pursue claims or compensation.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Entire Agreement

These Terms constitute the entire agreement between you and AKBAR TRAVELS OF INDIA LIMITED relating to your booking and supersede any prior communication or representation. No verbal representation by our staff or agents shall form part of any contract unless confirmed in writing.

Final Declaration

By proceeding with any booking with AKBAR TRAVELS OF INDIA LIMITED, you confirm that you have read, understood, and agreed to be legally bound by these Terms and Conditions in full.
